A Canadian business person recently contacted Berardi Immigration Law. She had held TN status as a Management Consultant for 13 years and had never had any issues with CBP. Upon her last TN renewal, she encountered resistance from the CBP Officer who granted her a one-year extension instead of the usual three. Shortly thereafter, one of her colleagues had their TN application denied outright. This individual wanted to ensure that her next renewal did not result in a denial and an inability to continue traveling to the United States for work purposes.

After providing us with details, we prepared a TN application as a Management Consultant on her behalf. A Management Consultant is one of 63 professions authorized by the North American Free Trade Agreement ("NAFTA") under the TN category.

Obtaining TN status as a Management Consultant can be difficult as CBP scrutinizes this particular category very closely due to widespread abuse. To demonstrate that our client qualified for this classification, we prepared a document describing the petitioning employer, the applicant’s educational and professional experience, and the proposed Management Consultant assignment. Supporting documentation was carefully crafted to address in advance potential questions that CBP Officers may raise.

When the application package was complete, we met our client at the Peace Bridge and submitted the documentation to CBP. Our client’s application was approved immediately and TN status was granted, as requested, for a three-year period enabling this individual to resume her employment in the United States.
