Working closely with our client, we collected office leases, articles of incorporation,

A Canadian business owner recently called Berardi Immigration Law.  He wanted to incorporate his Canadian sleep diagnostics company in Texas, but he needed the right visa to do so and didn’t know where to start.

After describing his situation to us, we prepared an L-1A petition on his behalf. The L-1A is a subcategory of the L-1 visa reserved for intracompany executives and management.

CBP’s definition of “executive” is quite strict, so to demonstrate that our client fit the role we prepared a document describing his job responsibilities, managerial duties, and the number of years he had been with the company to submit with his petition.

In addition, CBP also requires proof that an L-1A applicant controls and owns company assets, is authorized to set up operations and manage day-to-day activities, and has office space in place for a full year.

Working closely with our client, we collected office leases, articles of incorporation, photos of the office, and other information to include with his L-1A package.

When the package was complete, we took our client to the Peace Bridge and submitted his L-1A petition to CBP.

Our client’s petition was approved on the spot, and he is now successfully doing business in Texas. At the end of one year, when his L-1A will expire, we will work with him again to demonstrate to CBP that his business is able to support his position so his L-1 visa will be extended.
